1. Who we are

ashleylowe.com.au (the Site) is operated by Rise Up Constructions Pty Ltd (ABN 65 622 158 249) trading as The Content Cartel (we, us, our). The Site is the professional portfolio of writer Ashley Lowe.

This policy explains what personal information we collect through the Site, why we collect it, who we share it with, and what you can do about it.

We’re a small business, and businesses of our size are generally exempt from the Privacy Act 1988 (Cth). We’ve chosen to handle your personal information in line with the Australian Privacy Principles anyway, because we think that’s how it should be done. We also comply with the Spam Act 2003 (Cth) in the way we run the newsletter.

2. What we collect

We keep this deliberately minimal. The Site is a portfolio, not a shopfront — we don’t sell anything through it, we don’t take payments, and we don’t run advertising or retargeting.

  • Newsletter signup form. Your email address, and your first name if you choose to give it.
  • Contact / enquiry form. Your name, your email address, and whatever you write in your message — which may include your publication or organisation, and details of the work you’re enquiring about.
  • Automatically, when you visit. Our web host records standard technical information such as your IP address, browser type and version, device type, the pages you viewed, and the site you arrived from. This is aggregate traffic data, and we don’t use it to identify individual visitors.

We do not collect payment details, government identifiers, or sensitive information as that term is defined in the Privacy Act. Please don’t send us sensitive information through the Site.

3. Cookies

The Site is built on Shopify, which sets a small number of cookies necessary for the site to function and to record basic, anonymised visit statistics.

We don’t run Google Analytics, advertising pixels or third-party tracking on the Site.

You can block or delete cookies through your browser settings. Some parts of the Site may not work properly if you do.

4. How we use your information

We use the information above only for the purpose you gave it to us:

We don’t use your information for any unrelated purpose, and we won’t send you marketing you didn’t ask for.

5. The newsletter and Substack

Ashley’s newsletter is published and delivered through Substack, a platform operated by Substack Inc. in the United States.

When you sign up through the Site, you are giving express consent to be added to that list. We add your details to Substack manually, which means:

  • There may be a delay of up to a few days between your signup and your first email.
  • Your email address (and first name, if provided) is transferred to and stored on Substack’s systems in the United States, where it is subject to Substack’s own privacy policy and to United States law.
  • We rely on Substack to deliver the emails and to process unsubscribes.

Unsubscribing. Every newsletter email includes an unsubscribe link, which takes effect immediately. You can also email us at ashley@thecontentcartel.com.au and we’ll remove you within five working days. Unsubscribing removes you from the list going forward; it doesn’t require you to give a reason or pay anything.

If you would prefer your details not be stored outside Australia, please don’t use the signup form.

6. Who else sees your information

We do not sell, rent or trade your personal information. We share it only with the service providers we need in order to run the Site and the newsletter:

  • Shopify — hosts the Site and stores contact form and signup submissions in our admin account. Shopify is headquartered in Canada and stores data on servers in various countries.
  • Substack Inc. — delivers the newsletter. United States.
  • Our email provider — receives and stores enquiry correspondence.

Because these providers operate overseas, your information may be stored or processed outside Australia. We take reasonable steps to use reputable providers, but we can’t guarantee that overseas recipients will handle information in the same way an Australian entity would.

We may also disclose information where we’re required to by law.

7. How long we keep it

Newsletter subscribers. For as long as you remain subscribed. If you unsubscribe, Substack retains a record of the unsubscribe so you aren’t accidentally re-added; we delete your details from our own records.

Enquiries. For as long as needed to deal with your enquiry, and then for a reasonable period afterwards for our business records — usually up to seven years, in line with ordinary record-keeping practice. You can ask us to delete an enquiry sooner.

8. Keeping it secure

We take reasonable steps to protect your information from misuse, loss, and unauthorised access — including using reputable hosting and email providers, keeping accounts protected by strong passwords and two-factor authentication, and limiting access to the people who need it.

No system is perfectly secure. If a data breach occurs that is likely to cause you serious harm, we will notify you and, where the law requires it, the Office of the Australian Information Commissioner.

9. Access, correction and complaints

You can ask us at any time to:

  • tell you what personal information we hold about you
  • correct anything that’s wrong or out of date
  • delete your information, or unsubscribe you from the newsletter

Email ashley@thecontentcartel.com.au. We’ll respond within a reasonable period, usually within 30 days. There’s no charge, and we don’t need a reason.

If you’re not happy with how we’ve handled your information or your request, tell us first and we’ll do our best to sort it out. If you’re still not satisfied, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or 1300 363 992.

10. If you’re outside Australia

The Site is operated from Australia and is intended primarily for an Australian audience, but Ashley’s readers are welcome anywhere.

If you are in the European Union or the United Kingdom, the following applies to you:

  • Our legal basis. We rely on your consent to send you the newsletter, and on our legitimate interests in responding to professional enquiries and maintaining the Site.
  • Your rights. You may request access to your personal data, correction, erasure, restriction of processing, or a copy of your data in a portable format. You may object to processing based on legitimate interests. You may withdraw your consent to the newsletter at any time, which won’t affect anything we did before you withdrew it.
  • International transfer. Your data will be transferred to and stored in Australia and the United States, which are outside the EEA and the UK. By subscribing or contacting us, you acknowledge this transfer.

11. Children

The Site isn’t directed at children, and we don’t knowingly collect information from anyone under 16. If you believe a child has given us their details, email us and we’ll delete them.

12. Changes to this policy

We may update this policy from time to time. The current version is always the one published on the Site, and the “last updated” date at the top tells you when it changed. If we make a significant change to how we handle newsletter subscriber information, we’ll say so in the newsletter.
